1. Acceptance of terms
By creating an account or using any part of the PulseSupport platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Description of service
PulseSupport provides software tools that enable service businesses to:
- Deploy an AI-powered web chat widget on their website
- Manage appointment bookings through automated chat flows
- Collect payments for bookings via Paystack
- Manage FAQ and knowledge base content
- View analytics on visitor conversations and bookings
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Accounts and registration
You must provide accurate and complete information when creating your account. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of your business.
4. Subscription plans and billing
PulseSupport offers a free plan and paid subscription plans. By subscribing to a paid plan, you authorise us to charge your payment method on a recurring monthly basis.
- Subscription fees are billed in South African Rand (ZAR)
- Fees are charged at the start of each billing period
- Overage charges (additional AI replies or bookings) are billed at the rates shown on the pricing page
- Payment is processed by Paystack
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Please refer to our Refund Policy for information about refunds.
5. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Transmit spam, unsolicited messages, or harmful content
- Infringe the intellectual property rights of others
- Engage in deceptive, fraudulent, or misleading practices
- Attempt to gain unauthorised access to our systems or other users' accounts
- Use the Service in a way that could damage, disable, or impair it
- Collect or harvest personal data of users without their consent
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
6. Your content
You retain ownership of all content you upload to PulseSupport, including your FAQ entries, business information, and widget configuration (“Your Content”).
By using the Service, you grant us a limited, non-exclusive licence to use Your Content solely to provide and improve the Service. We will not use Your Content for any other purpose without your consent.
You are solely responsible for ensuring Your Content is accurate, lawful, and does not infringe third-party rights.
7. Visitor data and your responsibilities
When you deploy the PulseSupport widget on your website, your visitors will interact with our systems. You are the data controller for your visitors' personal information. You are responsible for:
- Ensuring your website has an appropriate Privacy Policy that discloses use of the PulseSupport widget
- Obtaining any necessary consents from your visitors
- Complying with applicable data protection laws (including POPIA)
- Ensuring your use of collected visitor data is lawful
8. Intellectual property
The PulseSupport platform, including all software, designs, trademarks, and content created by us, remains our exclusive intellectual property. These Terms do not grant you any right to use our trademarks or branding without our prior written consent.
9. Availability and uptime
We aim to provide a reliable service but do not guarantee uninterrupted availability. We may perform scheduled or emergency maintenance that temporarily affects access to the Service. We will provide advance notice of scheduled maintenance where possible.
10. Limitation of liability
To the maximum extent permitted by law, PulseSupport shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — including but not limited to lost profits, lost bookings, or data loss.
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the total amount you paid us in the 3 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless PulseSupport, its directors, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.
12. Termination
You may close your account at any time from your account settings. We may suspend or terminate your account if you:
- Violate these Terms
- Fail to pay subscription fees after a grace period
- Use the Service in a way that poses a risk to other users or our systems
Upon termination, your access to the Service will cease and we will handle your data in accordance with our Privacy Policy.
13. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
